LuCA (Life Coach Assistant) is an AI-powered life coach that is designed to help people overcome obstacles and achieve goals in their personal and professional lives in a way that is consistent with their values and beliefs.

LuCA draws from research-based coaching methodologies, and has been refined by mental health professionals and accredited coaching practitioners.

By using LuCA (referred to below as "the app"), you agree to comply with and be bound by the following Disclaimer and Terms of Service. Please read these terms carefully. If you do not agree to these terms, you should not use the app.

Beta Testing Acknowledgment

By using the app during its beta testing phase, you acknowledge and agree that:

Experimental Nature: the app is in beta testing, which means it is still in development and may not operate as intended. Features and functions are subject to change, and there may be bugs or issues that could affect your experience.

Feedback: We value your feedback to improve LuCA. By participating in the beta test, you agree to provide constructive feedback and report any bugs, issues, or suggestions through the designated feedback channels.

Disclaimer of Warranties

As-Is Basis: LuCA is provided on an "as-is" and "as-available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation, performance, or availability of the app.

No Guarantees: We do not guarantee that the app will be free from errors, secure, or that it will meet your expectations or requirements.

Limitations: The AI coaching provided by the app is for informational and educational purposes only. It is not therapy or a substitute for therapy. It is not a substitute for any professional advice, diagnosis, or treatment. Always seek the advice of a qualified professional for any personal or medical concerns.

Limitation of Liability

No Liability for Damages: To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the app, even if we have been advised of the possibility of such damages.

Assumption of Risk: You assume full responsibility and risk of loss resulting from your use of the app. We are not responsible for any personal injury, property damage, or any other loss or damage that may result from using the app.

User Conduct

Lawful Use: You agree to use the app in compliance with all applicable laws and regulations.

Prohibited Activities: You agree not to use the app for any illegal or unauthorized purpose, including but not limited to violating any intellectual property rights or privacy rights.

Intellectual Property

Ownership: All content, features, and functionality of the app are the exclusive property of The Forward Foundation (501c3).

License: You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes during the beta testing phase.

Privacy

Data Usage. We will not share or sell any of your data.

Confidentiality: We will protect the confidentiality and security of your personal information. However, we cannot guarantee absolute security.

Ability to destroy data: You have the right and ability to destroy your data by going into the history tab of the app and deleting it if you do not want us to review and keep your data. We will only review data that is more than 3 days old to give you a chance to decide whether you want to delete it or not.

Data Collection: By using the app, you consent to the collection and use of data you do not delete after 3 days. This includes the collection of feedback and usage data to improve the app.

Changes to Terms

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting. Your continued use of the app after changes are posted constitutes your acceptance of the revised terms.

Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice or liability, for any reason, including if we believe you have violated these terms.

Governing Law

These terms are governed by and construed in accordance with the laws of Texas without regard to its conflict of law principles.
